Can you grow cannabis at home in Switzerland? Short answer: THC cannabis no, CBD hemp yes under strict conditions. Unlike Germany (3 plants per person since April 2024) or many US states, Switzerland has no legal home cultivation for recreational use. This guide covers the 2026 legal status, the 1 % THC limit, penalties and legal alternatives.

The legal position in one sentence

Cannabis plants with more than 1 % total THC are narcotics under the Swiss Narcotics Act (BetmG). Cultivation, possession, trade and consumption are all criminal offences. THC vs. CBD: the 1 % limit

The Swiss exception is the 1 % THC limit — not 0.3 % as in the EU. Anything below is legal CBD hemp and may in principle be cultivated. However, cultivating CBD hemp still triggers rules:

In practice: a hobby grow of a legal CBD variety on the balcony is not criminal, provided the final product stays below 1 % THC and you don't sell. But once a plant "tips" (stress, late harvest → THC rises), you become an illegal grower objectively.

Seeds & clones — legal, but…

Selling cannabis seeds is legal in Switzerland because seeds contain no THC. Many Swiss seed banks openly offer genetics — including highly THC-rich ones. Germination for THC production is however prohibited. If you order seeds to grow a THC plant, you commit an offence the moment it germinates.

Clones are more tightly regulated because they already contain cannabinoids. CBD clones may be traded between certified producers; THC clones fall under BetmG.

Why a club is the legal alternative

Medical home cultivation with prescription?

In very rare individual cases BAG can grant an exceptional cultivation permit for medical purposes — in practice this is issued to licensed producers, not patients. Individual patient home cultivation is not foreseen in Switzerland as of 2026.

Future: legalisation & home cultivation

In autumn 2024 the Federal Council sent a preliminary draft on regulated cannabis sales into consultation. Whether home cultivation becomes part of the future law is open — current drafts prioritise state-controlled sale via licensed outlets.
