Cannabis while on sick leave in Switzerland: what to clarify
Cannabis and sick leave in Switzerland: separate treatment, work capacity, medical certificates, privacy, pay, insurance benefits and returning to work.
You are on sick leave and use prescribed cannabis, or wonder what recreational use means during your absence. Perhaps a return to work is approaching too. ‘A certificate means everything is allowed’ is not a useful answer. The relevant treatment, limitations and requirements of your actual job need consideration. This guide separates the questions and helps you prepare discussions with the appropriate people.
1. Separate sick leave, treatment and cannabis use
A medical certificate records the clinician’s assessment of incapacity or limitations. A prescription concerns the prescribed treatment. These do not automatically answer every question about duties, private activities or commuting. An absence or a single test result cannot by itself establish a cannabis-related diagnosis either. Start with the particular situation.
This guide mainly concerns private-law employment in Switzerland. Public-law employment can follow different rules. The employment contract, any collective agreement and existing insurance arrangements belong in the assessment. This page decides no individual case and promises neither protection from dismissal nor entitlement to benefits.

2. Discuss prescribed treatment and recreational use separately
If you use a cannabis medicine, prepare its name, formulation, concentration and current plan for the clinical discussion. Explain actual use and disclose other medicines and shop-bought products. Do not independently change or stop prescribed treatment out of concern about your employer; clarify questions with the responsible practice.
Recreational use does not become prescribed treatment merely because you are on sick leave. Equally, a prescription does not resolve every employment question. Ask whether use, symptoms or adverse effects matter to recovery and future duties. Being at home or not scheduled to work that day does not replace that discussion. Mention CBD products as well.

3. Assess capacity against the actual job
Tell your clinician what the work involves: concentration, shifts, customer contact, lifting, machinery or professional driving. A job title often does not explain enough. Describe symptoms that limit everyday activities and these tasks. Ask whether the assessment concerns your usual job, adapted duties or a partial return.
Incapacity due to an illness and possible current impairment related to cannabis are not the same thing. Both can matter without being treated as interchangeable. Feeling able to manage does not replace assessment of safety-critical requirements. A diary can organise observations for the appointment; it does not certify work capacity or prove treatment effectiveness.

4. Medical certificates and employer communication
The degree and expected duration of incapacity are particularly relevant to organising absence. For partial capacity, limitations need to be sufficiently clear. An ordinary certificate for the employer should not contain a diagnosis. That does not mean concealing safety-relevant restrictions. Clarify what information the job requires and how to communicate it without unnecessary clinical detail.
Check applicable reporting arrangements and deadlines. If an examination by a designated medical examiner is requested, ask about its remit, recipients and reporting scope. Medical confidentiality still applies; work capacity and diagnosis are different information. Do not pre-emptively send your entire medical history to a general HR chat. A dispute over data or evidence can require individual advice.
consider privacy and employment-law questions separately
5. Clarify salary and daily benefits separately
First establish whether the absence concerns illness or consequences of an accident. Sickness daily allowance insurance is different from accident insurance, and treatment costs are not lost earnings. Statutory salary continuation, contractual terms and an insurance arrangement may be relevant to illness. Documents and conditions need examination against the actual basis.
Cannabis use or a THC result automatically establishes neither exclusion nor entitlement. A prescription does not guarantee a particular payment either. If a benefit is refused or reduced, request a written explanation identifying the benefit, reasons and basis. Observe the applicable deadlines. Rules about reducing accident daily allowances should not simply be transferred to sickness absence.

6. Plan the return in practical terms
Before returning, discuss the workload, duties and next review. With partial capacity, clarify whether restrictions concern hours, performance or particular tasks. An agreed return date does not settle these points on its own. Changes to treatment or symptoms belong in the updated clinical assessment.
Safety-critical duties and commuting need separate consideration. Sick leave does not automatically mean unfitness to drive; returning to work does not automatically certify driving fitness either. Discuss treatment effects with the responsible professional and arrange another way to travel where needed. This article provides no universal waiting period after use.
7. When assessments do not match
The certificate, work schedule and department’s expectations may not align. Record the discrepancy factually: which duty, restriction and period? Ask the responsible parties to clarify it and share only the information needed. Independently adjusting treatment or quietly resuming unclear duties does not reliably resolve the conflict.
Separate clinical questions, workplace organisation and a legal dispute. The practice manages treatment; the agreed workplace contact organises duties. Disputed employment or insurance consequences can require independent advice. A club account does not replace any of these roles.
8. Checklist for the next discussion
Use these points to prepare specific questions rather than reaching your own medical or legal conclusion. The useful outcome is knowing who will clarify each issue and when to expect a response.
- Have the current certificate and relevant period available.
- Note the preparation, actual use and other medicines for your clinician.
- Describe actual duties and safety requirements.
- Clarify workload, restrictions and the next review.
- Agree reporting channels and information needed by the employer.
- Separate salary continuation, sickness allowances and accident benefits.
- Explicitly discuss commuting and return-to-work arrangements.
A way to start the clinical discussion
My certificate covers [period] or states [degree of incapacity]. I use [preparation or actual cannabis use]. My job involves [specific tasks]. Which limitations matter to recovery and returning, what information does the employer need, and when will we reassess the situation?
General orientation for Switzerland, not individual legal or treatment advice. The relevant professionals and organisations need to assess actual work capacity, treatment and benefit questions.

Join the clubFrequently asked questions
- Does a cannabis prescription replace a medical certificate?
- No. A prescription concerns treatment; the certificate records the clinical assessment of incapacity or restrictions. Clarify the questions separately.
- Is cannabis automatically permitted while on sick leave?
- Sick leave is not blanket permission to consume. Product, access route, treatment, recovery and employment consequences are different questions. Discuss the actual situation with your treating practice.
- Does my employer need my diagnosis?
- An ordinary certificate for the employer should not contain a diagnosis. Restrictions relevant to organising work still need clarification. Do not share clinical documents indiscriminately; ask what information is necessary.
- Does a THC result automatically mean losing daily benefits?
- That cannot be assumed generally. The benefit, cause of absence and legal or contractual basis need examination. A prescription does not guarantee payment either.
- Does sick leave automatically mean I cannot drive?
- Work capacity and driving fitness are separate assessments. Neither a certificate nor returning to work answers the driving question alone. Clarify treatment effects individually.
- What needs agreeing for a partial return?
- Workload, duties, relevant restrictions and the next review should be clear. Ask whether a restriction concerns hours, performance or particular activities.
