Swiss Narcotics Act Revision 2027 — the new cannabis framework
Since 2023, the SHK-N Cannabis sub-committee has drafted a regulated-supply proposal. Here is the current status of the legislative process, the draft's key points and a realistic timeline to entry into force.
TL;DR
- SHK-N Cannabis sub-committee working on draft since 2023.
- Consultation earliest late 2026, message 2027, entry into force ~2028–2029.
- Goal: regulated non-medical cannabis market under strict conditions.
- Basis: art. 8a NarcA pilot trials (since 2021) provide evidence.
- Adult consumption legal with youth protection, ad ban, quality standards.
Where does the revision come from?
The Siegenthaler motion 'Cannabis regulation with youth and health protection' was passed by both chambers in 2020. In 2021 the Federal Council delegated the mandate to the SHK-N; since summer 2023 a sub-committee has been drafting a bill.
In parallel, an amendment to art. 8a NarcA has enabled cantonal pilot trials ('Weed Care' Basel, 'SCRIPT' Geneva, 'ZüriCan' Zurich, 'Grashaus' Bern, etc.) since 2021 — they generate evidence for the political debate.
Key points of the draft
The publicly communicated framework foresees a controlled market opening: state-licensed production, specialised outlets, 18+ age verification, quantity limits, a strict advertising ban and THC disclosure at point of sale.
- Consumption legal from 18, prohibited and sanctioned below
- Sales only in licensed shops or Cannabis Social Clubs
- Swiss origin or EU-GMP standard required
- Earmarked cannabis tax financing prevention
- No combined sale with alcohol, tobacco or in supermarkets
Timeline and open questions
A realistic consultation window is late 2026 to mid-2027, followed by the Federal Council's message and parliamentary debate 2027–2028. Entry into force before 2029 is unlikely unless no referendum is called.
Open questions: home cultivation, cantonal autonomy over outlet density, interaction with roadside enforcement, and the concrete design of the cannabis tax.
FAQ
When will the NarcA revision enter into force?
Realistically 2028–2029 after consultation and referendum period. A faster track is politically possible but procedurally tight.
Will home cultivation be allowed?
The sub-committee has not yet decided. 3–6 plants per adult are plausible, analogous to the German and Maltese models.
What happens to the current pilot trials?
Trials under art. 8a NarcA run through end-2028 (extension option). Their results feed directly into the permanent framework.
Will cannabis remain a controlled substance?
Yes, formally it stays in the NarcA annex. A special licensing and supply regime will be created, comparable to alcohol under the AlcA.
What changes for Cannabis Social Clubs?
Clubs will likely gain a legal basis as non-profit supply points, subject to membership, quantity and prevention requirements.
