Can the employer test?

Baseline: personality protection (Art. 328 OR) and Federal Data Protection Act. No drug tests without consent. Exceptions if there is an overriding business interest (safety), proportionate and purpose-bound.

Dismissal — when is it lawful?

Off-duty use is a private matter and not grounds for dismissal. Lawful dismissal cases:

Ordinary termination: possible any time with notice period. Summary dismissal (Art. 337 OR): only for serious cause.

Safety-critical roles

Police, railways, pilots (FOCA), OR staff, heavy-vehicle drivers, crane operators — regulations enforce zero tolerance. Even CBD can cause trouble (see below).
