Consumption & possession — the CHF 100 fixed fine
Since October 2013 (NarcA Art. 28b): CHF 100 fine, no proceedings, no record. Requirements: adult, up to 10 g for personal use, no other offences.
Cantonal reality: GE and ZH enforce strictly, BE and VD more leniently.
Above 10 g — criminal proceedings
Above 10 g or with other narcotics: Art. 19a NarcA, misdemeanour, fine CHF 200–1,000, possible criminal record.
Repeat offence = higher fines, additional measures.
Trafficking — the big jump
Trafficking, import, export, brokerage (NarcA Art. 19 para. 1): felony, up to 3 years imprisonment. Serious case (large quantity or gang): up to 20 years.
Simple sharing with friends without profit is treated more leniently — but the line is blurry.
Special cases — driving, minors, employer
Driving: 1.5 μg/L THC → licence withdrawal min. 3 months. Minors: juvenile authority, graduated measures.
Employer: in safety-sensitive jobs a positive test can lead to dismissal.
